ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY

BY CHECKING THE AGREEMENT BOX, OR LEAVING IT BLANK BY DEFAULT AND SENDING IN MY MEMBERSHIP FORM, I UNDERSTAND, ACKNOWLEDGE, AND AGREE TO THE FOLLOWING STATEMENTS:

NOTICE: THIS IS A LEGALLY BINDING AGREEMENT WHICH IS INTENDED TO PROVIDE A COMPREHENSIVE RELEASE OF LIABILITY, BUT IS NOT INTENDED TO ASSERT ANY CLAIMS OR DEFENSES WHICH ARE PROHIBITED BY LAW. By acknowledging this Release through electronic signature and membership form submission, you give up any right you may have to bring a court action to recover compensation or obtain any other remedy for any injury to yourself or your property or for any death however caused arising out of participation with Legio XIIII GMV.

Reenacting can be a hazardous and dangerous activity, and events and activities related to or associated with reenacting can expose me to hazards and risks, both natural and artificial, which may result in harm, damage, personal injuries or death. 

My participation with Legio XIIII GMV is entirely voluntary and I understand that participation, involves hazards and dangers that may be outside of the Legion’s control that can result in harm, loss, damage, personal injuries, or death resulting from, arising out of, or related to all such usage.  I recognize that by reading the general rules and regulations of Legio XIIII GMV, I will have a more prepared understanding of safety and guidelines.

I recognize the dangers involved in reenacting living historical periods. I realize I am subject to injury from this activity and that no form of preparation can remove all of the danger to which I am exposing myself. I am aware of the safety policies of Legio XIIII GMV and I assume responsibility in following them. 

I acknowledge and understand that the Officers will take every precaution to ensure my safety, however, that responsibility ultimately falls upon me.

In consideration of being permitted to participate with Legio XIIII GMV, for myself and on behalf of my heirs, personal representatives and assigns, I hereby assume all risks and waive, release and discharge forever Legio XIIII GMV, its Officers, and members from any and all liabilities, claims, demands, or causes of action of any nature, whether known or unknown, for any harm, loss, damage, injuries or death, due to negligence or any other cause, resulting from, arising out of, or in any way related to my participation in any drill, weapons practice, reenactment, living history or recruiting function.

I will obey and comply with all rules, regulations, or instructions of Legio XIIII GMV and its Officers, and I have a responsibility to ask questions and clarify any rules, regulations, or instructions if I do not understand, fully comprehend, or have any doubts about any rule, regulation, or instruction.

I have an obligation and responsibility to myself, as well as other members of Legio XIIII GMV to conduct myself in a safe and responsible manner, and I will NOT participate in any event while under the influence of drugs or alcohol or suffering from or experiencing any condition that might impair me. 

I REPRESENT AND ACKNOWLEDGE THAT I HAVE READ THIS ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND FULLY UNDERSTAND EACH AND EVERY PROVISION AND THAT BY SUBMITTING THE ELECTRONIC MEMBERSHIP OR WRITTEN MEMBERSHIP FORM, I AM ELECTRONICALLY OR OTHERWISE SIGNING THIS AGREEMENT OF MY OWN FREE WILL.

I acknowledge and understand that Legio XIIII GMV does not accept applicants under the age of 18 years, unless they are participating under the family membership, and portray citizens or other historical characters relevant to the time period under the care and supervision of their parent(s) or guardian; however, I fully acknowledge that all rules, regulations and waivers of liability still apply.

I do not object to my name, address, membership and other details being held on computer for the purpose of distributing information and other administration purposes relating to Legio XIIII GMV and other organizations lawfully entitled to the same.

Whilst a member of Legio XIIII GMV, being a company Limited (against public liability) by Guarantee, I understand that I may be called upon to contribute such amount as may be required (not exceeding $20) into the Legio XIIII GMV’s assets for payment of the Legio XIIII GMV debts and liabilities or of the costs, charges, and expenses incurred in the event of the said Legio XIIII GMV being involved in costly litigation, winding-up, or going into liquidation.

Membership of Legio XIIII GMV lapses on 31st of December each year, when membership and the above declarations, are due for renewal.

I understand that I am applying to join a 1st through 3rd Century Living Historical group and as such will abide by the rules of authenticity relating to dress, weapons, equipment and tentage on all authentic camps and living history displays.

I declare that the information contained in this application form is to the best of my knowledge a true and accurate representation.

I have sent or enclosed a Check/Money Order for the amount required for my membership type, made payable to Legio XIIII GMV, or I have made my donation through the Donations page of the site.

Acknowledgment of Regulations

I have read the General Rules & Regulations for Members of Legio XIIII GMV, and agree to follow each of them. I understand that I am subject to disciplinary action and possible dismissal should I violate these rules.
